Terms of Use

Acceptance of terms

These Terms of Use (“Terms”) govern your access to and use of the Yips! mobile application (“Yips!” or the “App”), operated by Elli Consulting Services LLC (“we,” “us,” or “our”). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Eligibility

You must be at least 13 years old and capable of forming a binding contract to use Yips!. By using the App, you represent that you meet these requirements. Accounts for minors must be created and supervised by a parent or legal guardian where required by law.

Friendly wagers, not gambling

Yips! is a social golf app designed to help golfers track friendly wagers and side games among friends. Yips! is not a gambling platform, does not process real-money bets, and does not act as a bookmaker or casino. All wager tracking is for recreational and informational purposes only. Users are solely responsible for any real-world financial settlement and for ensuring that any friendly wagers comply with applicable laws and regulations in their jurisdiction.

User accounts

You need an account to use Yips!. You are responsible for the accuracy of your account information, for safeguarding your login credentials, and for all activity that occurs under your account. Notify us promptly at elliconsultingservices@outlook.com if you believe your account has been accessed without your authorization.

Your content and information

You retain ownership of the profile details, scores, game records, wager entries, and other information you submit. You grant us a limited license to host, store, process, and display that information as necessary to operate the App and provide it to the people you share it with (for example, your friends or playing group). You are responsible for ensuring you have the right to submit the information you enter.

Friend and social features

Yips! lets you connect with other golfers, join groups, and share golf activity. Information you share with friends may be visible to them and, through them, to others. Please treat other users respectfully and only share information you are comfortable sharing.

Golf scores and game information

Scores, statistics, handicap-style figures, and game records in Yips! are user-entered and provided for recreational tracking only. We do not verify their accuracy and they are not official scores or ratings issued by any golf association, club, or handicap authority.

User responsibilities

When using Yips!, you agree to:

  • Provide accurate and complete account information.
  • Maintain the confidentiality of your login credentials.
  • Use the App only for lawful purposes and in compliance with these Terms.
  • Respect the rights and privacy of other users.
  • Ensure that any wagers or side games you participate in are legal in your location.
  • Not use the App to facilitate illegal gambling, fraud, or harassment.

Prohibited conduct

You may not:

  • Use the App for any illegal, fraudulent, or unauthorized purpose.
  • Harass, abuse, threaten, or discriminate against other users.
  • Upload or share content that is offensive, defamatory, infringing, or unlawful.
  • Interfere with or disrupt the App, servers, or networks connected to it.
  • Attempt to reverse-engineer, decompile, or extract source code from the App.
  • Use automated means to access or scrape the App without our written permission.
  • Impersonate another person or misrepresent your identity or affiliation.

Intellectual property

The App, including its design, code, graphics, logos, and content, is owned by Elli Consulting Services LLC or its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.

Disclaimer of warranties

Yips! is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free from harmful components. Your use of the App is at your own risk.

Limitation of liability

To the maximum extent permitted by applicable law, Elli Consulting Services LLC and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or wagers, arising out of or relating to your use of the App, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the App shall not exceed the greater of (a) the total amount you paid us in connection with the App in the twelve (12) months preceding the event giving rise to the claim, or (b) the maximum amount permitted by applicable law. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, and some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. This section is subject to any mandatory consumer-protection rights you may have.

Indemnification

You agree to indemnify and hold harmless Elli Consulting Services LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your content, or your violation of these Terms.

Account termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that harms the App or other users. You may also delete your account at any time by following the instructions on our Support page.

Governing law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict-of-law principles, except where mandatory consumer-protection or other laws of your place of residence apply.

Disputes

If a dispute arises, please contact us first at elliconsultingservices@outlook.com so we can try to resolve it informally. If we cannot resolve it, you and Elli Consulting Services LLC agree that any dispute relating to these Terms or the App will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, United States, and both parties consent to the personal jurisdiction and venue of those courts.

These Terms do not require arbitration and do not waive any rights that cannot lawfully be waived. If you reside in a jurisdiction whose mandatory laws give you the right to bring a claim in your local courts, or to benefit from consumer protections that cannot be waived by agreement, those rights continue to apply and this section does not limit them.

Changes to these terms

We may modify these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after the changes become effective constitutes acceptance of the revised Terms.
